LEXRADIO gives the floor to professionals
Josephine PASIECZNY: Fabrice REYNAUD, judicial officer in Nanterre and Jean Philippe BOUVET, judicial officer in Nîmes, are the co-founders of the platform. DELIVRACT which dematerializes exchanges between legal professionals. This Legal Tech allows a lawyer to send his documents to be served, free of charge, to the platform without having to determine in advance the bailiff with jurisdiction over the town or towns where the recipients of his document are located.
It is a tool intended for legal professionals, but which ones? And within the framework of which common missions do you work with these professionals?
Fabrice REYNAUD: Originally, the platform was created for lawyers, because we realised that lawyers were wasting a lot of time looking for competent bailiffs on the territory, and therefore the initial destination of Delivract is the legal profession. However, we very quickly realized that there are professions that are interested, in particular litigation lawyers in companies, in insurance companies, because they too have documents to be delivered everywhere in France. This platform allows them to contact the person they want in just a few clicks, and allows them to avoid wasting time looking for a bailiff and therefore to devote themselves to value-added tasks.
Jean-Philippe BOUVET : This service is entirely free, because we simply want to be attentive to the needs of our clients: practices evolve, the tools at our disposal evolve, and we want to provide our correspondents with the most efficient tools.
Today, everyone pays attention to their ecological impact, to the conservation of their data with the RGPD which is an important subject: all these subjects are treated within a platform by bringing dematerialization, a cost reduction for lawyers or professionals but also by guaranteeing them a strict respect of the RGPD:
Compliance issues are important subjects for each of us, and we guarantee to use servers that are in France, we also guarantee to be extremely concerned about the processing and conservation of their data and we provide our correspondents and partners with an efficient, up-to-date service using the tools at our disposal, free of charge.
Joséphine PASIECZNY: Can you illustrate the use of Delivract with a use for example?
Jean-Philippe BOUVET: Let us take the case of a lawyer from Lyon who has a summons to be served on a multitude of recipients: in Lille, Marseille and Paris for example, i.e. in several jurisdictions of the Court of Appeal. Outside the platform and without the help of digital technology, he will be forced to find out which are the competent bailiffs for each of these recipients, send the summons to each of these bailiffs, follow up this sending to each of these bailiffs and then wait for the return of the served summons; this is a constraint in terms of time and cost and this is the answer provided by Delivract.
With DelivractThe lawyer will be able to send his deed to the competent bailiffs within these territories, by means of a single referral, and he will have a unique place where he can consult the follow-up of his requests, download all his deeds with a completely dematerialized and interactive process.
Joséphine PASIECZNY: If I am a bailiff in France, how do I become part of your network?
Jean-Philippe BOUVET: The network already covers all the Courts of Appeal and there is no territory in mainland France that requires the integration of a new bailiff;
It is important to understand that Delivract is not simply a network of bailiffs who come together to absolutely cover a territory. They are judicial officers who share the same values and a respect for the same working standard. For example, we apply ourselves to acknowledge receipt of documents on D or D+1, we apply ourselves to return the document served in less than 7 days.
These requirements oblige us to select bailiffs and to maintain a closed network.
However, we still need quality bailiffs overseas.
Joséphine PASIECZNY: And on the other hand, if I am interested in this service, how do I join?
Fabrice REYNAUD : C’est extrêmement simple, il vous suffit de vous connecter au site delivract.fr, remplir un formulaire d’inscription, et si vous avez été « invité » par un huissier de Justice, celui-ci vous a donné un code facilitant l’inscription qui est immédiate.
