VTC training: go through the bailiff

vtc bailiffSince 1 January 2016, in accordance with the Thévenoud law, adopted in 2014, candidates for the profession of VTC driver are no longer required to follow a 250-hour training course but to pass an exam in which they must answer about 100 questions. This change was supposed to facilitate the entry of new candidates into this profession and reduce the cost. The intervention of the bailiff during this VTC examination is more necessary than ever.

The questions are about:

-20 questions on the regulation of private and public transport
-20 questions on road safety
-20 questions about running a business
-20 questions on customer relations
-10 questions on the understanding of the French language
- 20 questions on the English language

The decree of February 2, 2016, modified on March 18, indeed provides that "the center must take all the necessary measures to draw up an objective and reliable report of the good conditions of the tests, by using for this purpose the services of a judicial officer or any other person presenting sufficient guarantees of good repute".

The role of this observer will be to provide reliable information on the good conditions in which the events are taking place.

But how can we provide an objective and reliable report?

The law of 22 December 2010 confers on the judicial officer's report a presumption of veracity, whereas a simple attestation from a person, even one that guarantees his or her good repute, will be considered as mere information, within the meaning of the law.

The difference is enormous: with a bailiff's statement of facts, the VTC examination centre will provide absolute proof of the conditions under which the examination took place, whereas a statement of facts of any other person can be questioned.
