PACS rupture

breach of contract

There are several ways in which Pacs can be broken:
- automatically: by the marriage of one or both partners or by the death of one of the partners.
- voluntarily: by a joint request of the partners, or by a unilateral decision.
It is obviously the latter solution that poses the most problems.

Automatic PACS rupture :

In the event of the death of one of the PACS partners, the PACS is dissolved on the date of said death. The civil registrar responsible for recording the death on the birth certificate of the deceased partner will note the existence of a PACS, and will notify the clerk of the court of first instance or the notary who registered the pact, who will be responsible for notifying the surviving partner.

In the event of marriage of one of the two partners, and automatically, the Pacs breaks up. Here again, the Civil Registrar in charge of keeping the birth certificate of the newly married partner, at the time of registration of the mention of the marriage, will notify the clerk of the court of first instance or the notary who registered the pact, who will be responsible for notifying the two partners.

The voluntary dissolution of PACS :

This willingness to dissolve PACS can come from both partners. In this case, it is up to them to fill in this CERFA document:

and to send it by registered mail, accompanied by an identity document to the clerk's office of the court of first instance or to the notary who registered the Pacs.
Dissolution takes place on the date of registration at the clerk's office or by the notary.

Unilateral termination of PACS: If only one of the partners asks for the dissolution of the PACS, it is up to him to contact a bailiff, so that this one serves his decision to the other one.
We then take care of the transmission of this act to the town hall (since 2017, it is at the town hall and no longer at the court that the PACS is concluded) or to the notary who received the initial act, who will inform you of its registration. It is on the date of registration that the PACS ends.
